BACS organizes conference on legal updates

The Bikol Association of Catholic Schools (BACS) conducted a conference on legal updates on February 24, 2018 at the Daragang Magayon Hall (DMH) of University of Santo Tomas-Legazpi. A total of 79 participants from the Catholic Educational Associations of Legazpi (Albay), Caceres and Libmanan (Camarines Sur), Sorsogon, Masbate, Daet (Camarines Norte), and Virac (Catanduanes) attended the seminar. BACS invited two guest speakers to discuss the topics: Legal Issues Related to Education and the Legal Requirements of Securities and Exchange Commission (SEC) for Catholic Schools.

In the morning session, Atty. Joseph Noel M. Estrada, legal counsel for the Catholic Educational Association of the Philippines (CEAP), discussed the Data Privacy Act of 2012 and how it can affect a school and its environment. The Republic Act No. 10173 or the Data Privacy Act (DPA) was implemented in 2012. One of its general provisions is “to protect the fundamental human right of privacy, of communication while ensuring [the] free flow of information to promote innovation and growth,” and for this purpose, a National Privacy Commission (NPC) was established. In 2017, NPC released an advisory that all Personal Information Controllers (PICs), businesses and organizations that collect, process, and retain information of individuals, should appoint a Data Privacy Officer (DPO) who would be accountable for the protection and security of data. Since a school is one of the biggest entities that collect information from students, teachers, and other parties, it should have a dedicated DPO to ensure that the process of collecting personal information would not violate the privacy rights of an individual. During the afternoon session, SEC Region 5 Director Atty. Marylou Duka-Castillo tackled the legal requirements needed by Catholic Schools for their renewal of SEC registration. Aside from the renewal requirements, Atty. Duka gave a rundown of the topics such as Corporate Register, Period for Filing, and Penalties.
